The E-2 Investor Visa allows a person to enter and work within the United States based on the investments he or she will be controlling, while in the United States. This visa should generally be renewed every two years, but there is no limit to how many times someone can update. Investment should be "substantial." Investor visas are only available to certain citizens. E-2 visas are also available for non-business investor employees, as long as people of the same nationality are with investors and are destined for roles in US business that are either executive/supervisory or require special expertise that is essential for efficient US company operations.

For a new startup, the investment must be large enough to start and operate the business. The amount of investment varies on the type of business. Investment will not be considered substantial if it is not large enough to utilize the business. USCIS will use the "Reverse Sheet Scale" to determine whether substantial investment is proportional to the overall cost of the company.

After finishing the business, investors must return to their home country, or change their status. The US Department of State does not allow two purposes for this type of visa, although it may be possible for E-2 visa holders to adjust their status to immigrant status. E-2 visa holders may leave the United States at any time.

Liability

Since no visa class depends specifically on E-2 visas, unmarried couples and children (under 21) may receive a derived E-2 visa to accompany the main alien. The duration of the visa for family members who have citizenship differs from the principal is determined by the mutual agreement between the nationality state and the United States. Only if there is no such reciprocal agreement, the duration will be the same as the main applicant. Dependents may seek employment in the US by applying for a work permit using Form I-765, Application for Work Permit. Children under 21 can not apply for jobs; only the pair of E-2 holders can.

Documentation required for embassy

Each visa applicant must pay a non-refundable non-immigrant application fee of $ 205 and a visa issuance fee fee for certain countries.

The required documents are:

  • Non-Immigrant Online Visa Electronic App, Form DS-160. The Department of Foreign Affairs has a DS-160 web page that details the online process of DS-160.
  • Non-Trafficking Agreement/DS-156E Investor Application Agreement, completed and signed, for key executives/managers/employees.
  • The passport is valid for travel to the United States and with a validity date of at least six months beyond the applicant's intended period of stay in the United States. If more than one person is included in the passport, each person must complete the application Form DS-160.
  • Photos are 2 x 2 inches (5 by 5 cm).
  • As part of the visa application process, an embassy consular interview is required for almost all visa applicants.
  • A credible business plan that shows that a US business will generate enough money to support the applicant during his stay in the US along with all of his dependents. Business should not be marginal.
  • Business registration for US business.
  • Proof of wire transfer.
  • Proof of source of income.
  • Proof of intention to return to your country (because this visa does not allow double intentions).

How to register

Applicants must generally apply at the US Embassy or Consulate accredited for their permanent residence. As part of the visa application process, an embassy consular interview is required for visa applicants from ages 14 to 79. Persons aged 13 and under, and over 80, generally do not require interviews unless requested by the embassy or consulate.

During the visa application process, usually at the time of the interview, a scan of digital fingerprint without ink will be taken before the interview. Some applicants will need additional screening, and will be notified when they register. The E-2 visa application process varies from Consular Post in one country to another as there are often differences in visa processing policies and procedures.
